
TERMS AND CONDITIONS
Effective Date: April 30, 2025
By using this website or booking a service, you agree to the following terms:
1. Booking & Payment:
A deposit of 20% is required to confirm your booking. By paying the deposit for the photoshoot, you agree to the Terms of this contract.
80% of the remaining balance is paid on or before the day of the shoot.
2. Session Details:
The client is responsible for dish preparation and presentation.
Travel fees may apply for locations outside Sydney.
Additional time or changes outside the agreed scope may incur extra charges.
3. Delivery:
Edited images will be delivered within 3–5 business days unless stated otherwise.
Urgent delivery is available at an additional cost upon request.
4. Image Usage Rights & Licensing:
All images created by the Photographer are protected under applicable copyright laws. The Photographer retains full ownership and copyright of all photographs, including all original RAW files, which will not be shared with the Client.
The Client is granted a non-exclusive, non-transferable commercial use license to use the final edited images strictly for the agreed purposes, such as marketing, social media, website use, and menus. This license is valid for five (5) years from the date of delivery.
The Client may not resell, sublicense, or use the images for product packaging, third-party promotions, or any commercial resale activities without obtaining prior written permission and a separate licensing agreement from the Photographer.
Use of the images is permitted only in accordance with this Agreement. Ownership of image files does not imply unrestricted usage. Additional licensing — including print and resale rights — is available upon request and may incur an extra fee.
5. Cancellation Policy & Refunds:
If the Client cancels the session within 5 days of the scheduled date, the deposit will be forfeited.
If the Photographer cancels the session due to unforeseen circumstances, a full refund of the deposit will be provided, and efforts will be made to reschedule the session.
Due to the nature of creative services, all sales are final. Reshoots may be arranged in specific cases at the photographer’s discretion.
6. Limitation of Liability:
While every effort will be made to deliver services as agreed and to exercise reasonable care in the execution of this contract, the Photographer shall not be held liable for any delays or disruptions caused by circumstances beyond their control, including but not limited to acts of nature, technical failures, or unforeseen scheduling conflicts. Additionally, the Photographer is not responsible for any loss, damage, or deterioration of food items or other property provided by the Client during the session.
7. Model Release:
The Client grants permission to the Photographer to use the images for portfolio, marketing, and promotional purposes. This includes but is not limited to the Photographer’s website, social media, and print materials.
